A Prenuptial Agreement Is Important For The Poorer Party Entering Marriage

Posted on: 13 November 2014

A prenuptial agreement doesn't just protect the rich, you may want one if you're the weaker financial party entering into a marriage. If you know that you aren't going to work so you can raise kids and take care of the home, and you aren't bringing wealth into the marriage, you will need protection if the two of you split.

You will want to know that you will have money to start a new life, support any children that you have, and to maintain your lifestyle if you get divorced. Here are a few things a lawyer will want to include in your prenuptial agreement.

Alimony

If you don't think you'll be able to go out and get a job right away if you were to get divorced, you will want to know you have alimony. If you wouldn't be able to support the lifestyle your new marriage will bring you without your spouse, your lawyer will make sure your alimony keeps you comfortable after the two of you are over.

You may want to increase the amount you ask for, with the amount of time that you are married. You may also want to ask for a lump sum of money in the event of divorce.

Living Needs

Make sure that you will get the vehicle that you are already driving if you two decide to file for a divorce, or that you will be able to stay in your home. If there are multiple properties or multiple vehicles, your lawyer can help you decide which ones you should be eligible to have. This way you don't end up without transportation, or without a place to stay. You could also request that you can stay in the home until the divorce is finalized.

Assets

You will want to protect the gifts that you were given, and the items that were purchased for you during your relationship. Have your lawyer put that you get to keep all jewelry, clothing, accessories, artwork or other valuable items that were given to you as gifts.

Have your lawyer look over any prenuptial agreement that your future spouse wants you to sign, and make sure these additions are added to the document. It's important that you don't end up spending years in a marriage not working or earning any type of income, to be left with nothing if the two of you go your separate ways.

Child Support Enforcement Secrets: What You Should Know

If your ex was ordered to pay child support as part of your divorce settlement, you have every reason to expect it to be paid on time. If he or she isn't meeting that obligation in a timely manner, you do have some enforcement options. Instead of struggling to get by or finding yourself fighting with your ex about getting the payments you're entitled to, you should reach out to a child support attorney who can help you take the case back to court. Your ex will have to show just cause for why he or she isn't paying or the courts will order them to catch up. I created this site to share what I've learned about child support enforcement over the years. I hope it helps you to understand your rights and the options available to you.
